The Island House Gift Card Policy
– All The Island House Nassau (TIH) Gift Cards are only issued and distributed via The Front Desk.
– The duration of each TIH Gift Card is 1 (one) full year from date of purchase.
– TIH Gift Cards can be used for payment in every outlet on property (Shima, Mogano By Giorgio Locatelli, The Market, Island Pizza, The Cinema, Bamford Spa, Yellowbell and Rooms).
– Every outlet on property can provide the user with the expiry date of the card.

 

The following are the terms and conditions (“Terms and Conditions”) that apply when you reserve a room at The Island House Nassau (the “Hotel”). As a guest of the Hotel, and by reading and signing your hotel registration card at check-in or when booking a reservation on our website, you are agreeing to abide by the Hotel’s Terms and Conditions.

Terms and Conditions apply upon confirmation of your booking until your final checkout and departure from the property.

Reservations
In order to guarantee your booking, a valid credit card must be provided, and you must be at least 18 years old to make a reservation.
Please check that the details of your reservation are complete and accurate before you confirm your booking. We will not be liable for any delay or non-performance if you provide us with incorrect information. If you think that there is a mistake in your reservation or if you require any changes to a confirmed booking, please contact us (info@the-island-house.com) to discuss. All reservations are only confirmed upon receipt of deposit for length of stay. We will confirm our acceptance of your booking by sending you an email to the email address that you provide during the booking process. The contract between us for the provision of your room and any additional services added to your booking will be formed when you receive this email confirmation from us.
All bookings are subject to availability.

Occupancy
The Hotel offers rooms based on double occupancy. Children under 18 are not permitted to stay in the Hotel unless a parent or guardian is also staying in the Hotel. There must be at least one parent or guardian per room with a child under the age of 16. Rollaway beds are available upon request. As the person making the booking (the “Primary Guest”), you are responsible for any damage/loss caused by each additional guest (“Additional Guest”) registered under your booking, if any (collectively, the “Registered Guests”).

Room Rates and Payment
Room rates are based on double occupancy, a charge of $75.00 per person applies for additional guests (children under 12 are no additional cost) with up to 4 guests staying in our regular rooms and up to 5 guests in our Suites. Rollaway beds are available upon request. A $60.00 resort fee per room is added at the time of booking. All prices are inclusive of value added tax (VAT) at the applicable rate at the time of your booking, there are no additional room fees or taxes. The Hotel reserves the right to revise rates at any time. Payments may be made by cash, credit or debit card. The expiry date of your debit/credit card must be later than the end of your stay.
The following amenities are included in the price of the room and are available to all Registered Guests: Private beach access and shuttle, 25m lap pool, use of pool loungers, gym and movement studio classes, squash courts, cinema, use of the library, complimentary WiFi throughout the hotel, valet parking and self-parking.
The following facilities are available to you and to all registered guests at an additional charge: The Bamford Spa, The Market, dinning at Mogano by Giorgio Locatelli, Shima, Yellowbell and Island Pizza; package shipping and receiving, laundry services, room service and mini bar.

Upon check-in a security deposit of $100.00 will be authorized to your credit/debit card to guarantee any additional services charged to your room bill, this is increased as the incidentals reach $100.00. This will be returned to you in the method that you paid, upon your departure, less any incidentals you incurred during your stay with us. Further you hereby authorize the Hotel to charge a further deposit if the Hotel deems it appropriate in its sole discretion, this will be returned to you in the method charged upon your departure, less any incidentals you incurred during your stay with us.

Please note that all credit/debit card transactions (charges and refunds) though released immediately, may take 7-14 business days to process by your bank. Irrespective of billing instructions, as the Primary Guest you agree to be personally liable if any Additional Guest fails to pay any of the charges. Further you authorize your total hotel stay expenses to be charged to the credit/debit card used to book your stay. The Hotel may bill your presented credit/debit card in the event you fail to sign it as a charge record upon checkout. You as the Primary Guest hereby acknowledges and accepts responsibility for payment of all charges incurred by any additional associated Registered Guest. If you as Primary Guest decide to leave the Hotel prior to the reservation end date, you authorize the Hotel to charge the total amount of nights contracted, including the ones not used due to the early departure.

Check in/Check Out
Check-in is from 3pm. If you arrive earlier, we will be pleased to store your luggage until your room is ready and will try to accommodate you immediately if possible. Upon check-in, guests will be required to provide a valid credit/debit card along with a valid form of photo identification. Check-out is by 11am. If you require a late check-out, please contact us before 5pm the day before your departure and we will do our best to accommodate your request.

Cancellations
All extensions, cancellations and refunds are at the discretion of management.
All bookings are only confirmed upon receipt of payment depending on the scenarios listed below:
GENERAL DEPOSIT & CANCELLATION POLICY: Upon booking any room on any channel, whether directly with the Hotel or on any OTA channel, the Hotel requires a 2-night deposit. The Hotel will retain the 2-night deposit when cancelling within 14 days prior to check-in.
CORPORATE DEPOSIT & CANCELLATION POLICY: A 1-night penalty will be charged to all of our Corporate Partners when cancelling a room within 72-hours prior to arrival.
FESTIVE SEASON DEPOSIT & CANCELLATION POLICY: The following terms & conditions apply for all reservations between December 16, 2022 – January 4, 2023.
A 5-night minimum stay is required for all room types during this period. A 50% deposit of the total is due at time of booking, with the remaining 50% due 31 days prior to arrival. When cancelling on/or before 31 days of arrival, a 2-night penalty fee is charged. Cancellations within 31 days of arrival will result in no refund.

Force Majeure:
We may cancel your booking if an event outside of our control including, without limitation to, labor difficulties, mechanical breakdowns, flood, fire, explosion, earthquake or similar catastrophe, epidemic or quarantine restrictions, acts of God, acts of government or of any governmental or regulatory or fiscal authority or agency, storm, tempest, accident (a “Force Majeure Event”); provided that the Hotel shall use all reasonable efforts to minimize the effects of such a Force Majeure Event. In this case we will contact you to let you know as soon as possible and we will refund the total you have paid in respect to your booking.
Save as set out above, the Hotel shall not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by a Force Majeure Event.
This does not affect your statutory rights.

Storm Policy
Within 72 hours of a Hurricane/Tropical Storm watch issued by The Bahamas Department of Meteorology for the island of New Providence, the following policies apply to arriving guests needing to make changes to their booking.
Arriving guests may reschedule their confirmed stay within 6 months of the original booking. The hotel will make every effort to accommodate the new dates requested and the original room category.
If the guest chooses to cancel fully, the hotel agrees to waive all penalties and offer a complete refund.
On-property guests needing to extend their stay at the Hotel due to delayed flights resulting from a storm warning will be able to do so at the nightly rate on which the guest was originally booked based on availability.
Guests choosing to leave the hotel during a storm warning will be refunded the unused portion of their stay.
As the safety of our guests is paramount, within 48 hours of a Category 3 hurricane warning issued by The Bahamas Department of Meteorology for the island of New Providence, all guests will be asked to vacate the property to seek alternative accommodations and are encouraged to leave the island. Airport information will be available at the front desk to assist with your departure, the hotel will offer a complete refund of all unused nights.

Obligations of Registered Guests
Housekeeping attends the room twice daily. The hotel guest has the right to refuse entry, but the Hotel has the right to enter and refresh the guest room at least once within 48 hours of the stay to ensure our standards are upheld and check on the health & safety of the guest.
Smoking is not permitted anywhere inside the Hotel buildings found on property; this includes the smoking of e-cigarettes. Permitted smoking areas will be identified on site and smoking on the Hotel premises outside of the designated smoking area or in room, may result in a fine up to $750. Please be considerate of other guests if you do smoke.
Only one service dog is allowed to stay in your guest room. We will charge a standard $250.00 cleaning fee for each stay, but reserve the right to charge up to $500.00 for the deep cleaning of the room if needed. All dogs are required to be on a leash at all times. The cinema, spa, pool area, gym, movement studio and inside any of our restaurants are off limits for all dogs.
You may not use any electrical appliances that may set off the fire alarm system, such as toasters, mini cookers or portable grills within the room. You may not tamper with any fire alarms or emergency equipment.
You may not remove, damage or destroy any of the Hotel property.
You may not use any of the technology provided by the Hotel to download or access any unlawful or obscene material. You may not cause unreasonable disturbance to our or other guests or any of the Hotel staff.
If you as Primary Guest or any Additional Guest cause damage or loss of any kind to the Hotel, to other guests or their property, you as the Primary Guest will be responsible for that damage or loss, and you shall be liable to pay to the Hotel on demand the amount required to make good or remedy such damage or loss. If you as Primary Guest or any Additional Guest causes damage to the Hotel, other guests or their property, or otherwise breach any of these Terms and Conditions, the Hotel reserves the right to:
– Cancel your booking with immediate effect and (if appropriate) eject you from the Hotel premises;
– Retain all sums paid by you and/or charge you the full amount of your booking; and/or
– Refuse future bookings from you and/or refuse you entry or accommodation at the Hotel.
The Hotel will not be liable for any refund or compensation in such circumstances.
You as the Primary Guest or any Additional Guest must not resell or transfer your booking (or any part of it) nor advertise, market or otherwise offer any hotel room for sale, either on its own or as part of a combined offer. The Hotel will not honor any booking made in this way and does not accept any liability for doing so.

Hold Harmless and Waiver
Each Registered Guest agrees to all risks associated with the use of the Amenities and Facilities of the Hotel and agrees to release the Hotel from, defend and indemnify the Hotel against, any and all claims, whether or not based on the acts or omissions of the Hotel against, arising out of or in any way connected with the Amenities and Facilities of the Hotel by each Registered Guest. As used in this paragraph, the word “Hotel” shall be construed to mean The Island House Hotel Nassau Ltd., which includes, without limitation its officers, directors, employees, equity holders, representatives, agents, respective affiliates, subsidiaries and related companies and their heirs, executors, administrators, successors and assigns. Each Registered Guest assumes sole responsibility for their property. Each Registered Guest understands and agrees that the Hotel shall not be responsible for any loss or damage to any private property used or stored on the premises of the Hotel, whether in lockers, safes or elsewhere. Each Registered Guest also understands and agrees that they shall be liable for any property damage and/or personal injury at the Hotel, or at any activity or function operated, organized, arranged or sponsored by the Hotel, caused by the Registered Guest.

Disclaimer
The Registered Guest shall indemnify the Hotel (its successors, assigns, heirs, employees, officers, agents) against all reasonable out-of-pocket fees, costs, charges, expenses, liabilities, claims, demands, damages, losses, actions and proceedings of any kind which the Registered Guest may suffer or incur by reason of the Hotel, save and except for those caused by the willful neglect, gross negligence or willful misconduct of the Hotel.

Confidentiality
We process information about you that you provide when making a booking and/or upon check in at the hotel in accordance with our privacy policy. By providing this information you consent (on your behalf and on behalf of each member of your group) to such processing and you warrant that all information provided by you as the Primary Guest and any Additional Guest is accurate.

Applicable law
These Terms and Conditions shall be governed by, interpreted and construed in accordance with the laws of the Commonwealth of The Bahamas. The Registered Guest hereby submits to the exclusive jurisdiction of The Bahamas and the courts of The Bahamas shall have exclusive jurisdiction over any claim arising from, or related to your booking at the Hotel.
Each Registered Guest agrees that any claim arising out of, or relating to the Primary Guest reservation (or advertisements relating thereto), travel, accommodations, services, facilities, amenities, activities while a Registered Guest at the Hotel (whether on the Hotel premises or elsewhere) or relating in any way to the Registered Guests’ stay at the Hotel, whether made against the Hotel, its agents, employees, affiliated corporations or otherwise, shall be governed by and construed in accordance with the laws of The Commonwealth of The Bahamas (without regard to its conflict of laws principles), and further, each Registered Guest irrevocably agrees that the courts of The Bahamas shall be the exclusive venue for any such claim. Each Registered Guest expressly represents that this is a waiver of any right to a jury trial a Registered Guest otherwise may have and is a waiver of any right to bring such claim in any other country or location. Each Registered Guest further represents and agrees that the terms of this paragraph shall apply to and be binding on all persons accompanying the Primary Guest and the Primary Guest expressly represents that it has the authority to sign this agreement on their behalf.

Severability
If any part of these Terms and Conditions is deemed invalid, illegal or for any reason unenforceable then that part will be deemed deleted and will not affect the validity and enforceability of the remaining parts. Any failure by us to enforce our rights or remedies under these terms and conditions or otherwise shall not be construed as a waiver by us of those or any other rights or remedies.

Entire Agreement
These Terms and Conditions constitute an agreement between the Hotel and each Registered Guest and supersedes any prior understanding or representation of any kind between the parties and cannot be altered or waived unless in writing signed by both parties. These Terms and Conditions are binding on the Hotel and each Registered Guest, and on the parties’ respective heirs, successors, executors, and assigns.
